Accident Types

Motor

Motor accidents happen all too frequently.  The lack of care of another driver can cause you serious injury and distress.

However, the care that you take in the legal advice and representation you choose after an accident can have a positive affect on your recovery from injury and your ability to claim compensation.

Although we cannot stop accidents happening, we can reassure you that your losses and expenses will be recovered with the minimum amount of stress and disruption.  We can guarantee that we will always act in your best interests and ensure that you are fully aware of your rights and of the options that are open to you.

Insurance companies are now more likely than ever to try to settle motor accident personal injury claims directly with the injured person, without the injured person having any independent legal advice.  In claims we have pursued for injured people who were originally offered settlements directly by an insurer, we have been able to negotiate settlements far in excess of the monies that were offered before a solicitor was instructed.  You have a right to independent unbiased legal advice, and when that advice is offered for free, it makes sense to use it.

A personal injury claim is a legal process and there is no substitute for specialised, qualified legal advice to ensure that all of your expenses and injuries are recovered and you are compensated in full.

We will discuss your injuries with you and explain how we can assist you to access a full portfolio of rehabilitation services to give you the   best chance of recovery from your injuries.

If you have been injured in an accident that was not your fault and you are unsure of what to do next, please contact us and we will be happy to advise you on your legal rights.

Accidents at work

You spend a large proportion of your life in a work environment. Whilst standards of Health and Safety in the work place have improved in recent years, accidents at work are regrettably still commonplace.

All employees have a right to a safe and secure working environment, but mistakes are made, corners are cut and profit is put before people. Accidents inevitably happen. When they do you need specialist legal advice to guide you through the legal process.

Accidents at work can be the most stressful type of accidents, because not only does the injured person have to cope with their injuries, they also have to deal with the emotional and financial uncertainty of taking time off work whilst they recover and also of making a legal claim against their employer.

We are aware that the first question many of our clients ask after being informed that they have a good claim is “will making a claim against my employer cause me a problem at work?”
The answer is that like motor insurance for drivers, employer’s liability insurance is compulsory for employers. Once we have notified the employer of the claim they will pass it to their insurers to deal with.

Employers cannot legally discriminate against employees who make claims against them. Obviously in the real world we cannot guarantee this; occasionally some employers will be unhappy at the claim and it might cause a problem, but in our experience this is very rare. Often if an employee has been injured, an employer will do all they can to help the injured employee to recover and to return to work fit and well. In 2009 / 2010 some 78,744 people made claims against their employers because of an accident at work, so this really is not a rare occurrence.

The legal system does not have to be intimidating; it is there to protect you and to provide you with the means to claim compensation for your injuries, expenses and loss of earnings.

Medical Negligence

We all look to medical professionals for their support and we trust their skills and decision making. Unfortunately they occasionally get things wrong and, because of the nature of medical procedures, the results of these mistakes can have a devastating effect on your health and your quality of life.

The statistics for medical negligence cases make startling reading.   A recent study of medical records of patients shows that around 10% of admissions to hospital suffer some form of harm. This means that there were over 1 million cases of medical negligence during 2009/2010, yet only 0.6% of these cases resulted in the patients that had been harmed seeking compensation. The National Audit Office also reports that over half of all cases of patient harm could have been avoided.

When bad decisions are made in the medical profession, it is of course the patient who has to learn to live with the consequences of those decisions. You need professional advice to help you with your legal right to compensation. Our expert solicitors are trained and experienced enough to understand exactly what went wrong and to ensure that if you have a case, you receive your rightful compensation.

Medical claims mainly occur when a Doctor, Nurse or Medical Professional does not perform their duties to the professional standards that are expected of them. This can be due to misdiagnosis, inappropriate treatment or inappropriate medication.

As well as the right to compensation for your injuries, by making a claim you are highlighting where mistakes have been made within the medical profession.   This will help to prevent the same things happening to others. To give some perspective to this the direct costs to the National Health Service of patient safety incidents caused by the National Health Service in terms of bed days as reported by the National Patient Safety Agency is said to be £3 billion each year.

We will discuss your injuries with you and what we can do to assist in enabling you to access a full portfolio of rehabilitation services to give you the best chance of recovery from your injuries.

Medical negligence will generally fall within some specific categories, some of which are listed below

Cancer Misdiagnosis Erb's  Palsy
Cerebral Palsy Birth Injuries
Delayed Diagnosis Surgical Injuries
Delay in Treatment Failure to Diagnose
Pre-eclampsia  Shoulder Dystocia
Forceps Injuries Incorrect Treatment

Slips and Trips

Slips and Trips on uneven or unclean floors, roads, pavements or steps are a common cause of injury.

Local Authorities have a duty to ensure that roads and pavements are adequately maintained and are safe for use. In many areas Local Authorities fail in their duties. A lack of general maintenance leads to roads and pavements falling into disrepair and becoming a danger to those using them.

Injuries caused by trips on potholes or uneven surfaces can be extremely serious, and can often include broken limbs, facial injuries and damage to hands and feet.

As well as injuries caused by trips on roads and pavements, injuries also often result from slipping accidents in places open to the public, for example, supermarkets, shopping centres, sports centres, cafes, pubs and nightclubs. These can again be the result of poorly maintained floors and surfaces but can also be caused by poorly sign posted maintenance work or cleaning practises that do not follow health and safety guidelines.

In all of these cases the main issue with pursuing a claim is proving that the accident was caused by a defect and action has to be taken quickly because the problem should be fixed after an accident has occurred. It is helpful if the accident has been reported.

Where there is a defect on a road or pavement,  photographic evidence is always necessary because we  need to see the problem or fault that caused the accident and good quality photographs are vital. The photographs should show the scale and size of the fault and also the location by including any identifiable landmarks. Our advisers can talk you through this process and how to gather all the required information.

We will discuss your injuries with you and what we can do to assist in enabling you to access a full portfolio of rehabilitation services to give you the best  chance of recovery from your injuries.

Head injuries

Head and brain injuries can occur as a result of almost all of the accident types that are listed on this site, often the first issue that head and brain injury clients have is ensuring that they are correctly diagnosed and obtain advice from professionals with the correct training and level of experience.

There are specific differences between head and brain injuries but the two are often confused or one or the other term is used to describe the injuries as a whole.

Head injuries tend to be visible physical injuries such as fractures, lacerations or bumps or bruising causing visible swelling.

Brain injuries are not visible but are still a physical injury such as bleeding of the brain, swelling or lacerations or bruising of the brain. It does not always follow that just because you have suffered a swelling of the brain or a bleed in the brain that you have suffered a brain injury as this is not always the case.

The injuries that are not immediately visible are often the ones that are the most dangerous and can cause more damage or other symptoms. The symptoms are also not always apparent immediately after the accident, a particular trait of brain injuries is that they are easily missed and cannot always be diagnosed immediately after an accident. It is common for head injuries to be treated immediately because they have physical signs such as bleeding and bruising, but brains can be injured with no outward physical signs of injury and are therefore often missed during the initial diagnosis.

If you bump or severely jolt your head as a result of an impact of any type then it is possible that you may have suffered a head or brain injury. If you have bumped your head or severely jolted it in any accident we can advise you whether or not you should ask for further medical investigation. You do not have to have been knocked unconscious to suffer a brain injury.

Head and brain Injuries do not have to be caused by one specific injury.   If a person has suffered a number of smaller bumps and jolts to the head then some level of brain damage can be caused as a result of those bumps or jolts.

Brain injuries more than any other injury require specialist knowledge, often the symptoms and signs that the brain has been injured can be very subtle, and the brain injuries themselves can make it difficult for the individual to explain exactly what has happened and give descriptions of the extent of the injuries.
We have Lawyers that have many years of experience in dealing specifically with brain injuries.   The importance of experience when dealing with brain injuries cannot be underestimated.   Our lawyers can talk you through all of your options and provide advice and support on how to deal with brain injuries and their rehabilitation, as well as your legal options and rights to compensation.

Injuries to the spine

Spinal cord injuries can have a devastating effect on a person’s quality of life.   The spine is an extremely complicated area of the body, and any damage that is caused to the spinal column can have a catastrophic affect to a person’s life and their ability to live independently.

A spinal cord injury refers to any injury to the spinal cord that is caused by trauma rather than disease. The severity and effects of the injury can depend on where the spinal cord and nerve roots are damaged.   The associated symptoms can vary widely, from pain and discomfort to complete paralysis. Spinal cord injuries are described at various levels of "incomplete" which can vary from having no effect on the patient to a "complete" injury which means a total loss of function.

Spinal injuries can be caused by almost all of the accidents that are listed in this Website.   However some types of accident are more likely than others to be associated with spinal injuries.   What is important with injuries in this type is the level of rehabilitation care that is administered after the accident.

Accidents which can  cause spinal injuries are

Motor accidents
Falls
Slips and Trips

Accidents at work
Sports accidents

The knowledge and care of spinal injuries has developed greatly in recent years.   Whilst there is no way to reverse the damage in a spinal cord once it has happened, there is a much greater understanding of the care needed when a spinal injury has occurred.   Mainly there is a need to immobilise the area immediately after the accident to prevent any further damage whilst the initial injury is being assessed.

Once the injury has been assessed, the primary focus should be to establish and stabilise the injury and stop to any further injuries being caused.   This may require surgery or may be possible through the natural healing process.

Once the individual is stabilised, care and treatment focuses on supportive care and rehabilitation. Family members, nurses, or specially trained carers give supportive care. This care will include helping the individual to deal with day to day tasks such as bathing, dressing, changing positions to prevent bedsores, and other assistance.

Specialist legal knowledge is essential to assist with costs and future care.   This cannot be underestimated and the need to appoint the correct legal professional is imperative to the future care and security of the individual. A number of our solicitors have extensive experience in this area and can provide outstanding guidance and support.
